Terms of Service

Last updated: 12 September 2026

These Terms of Service govern your purchase of and access to AI Content Manager by Rachael Berry (“AI Content Manager”, “we”, “us” or “our”). By purchasing, creating an account or using the service, you agree to these Terms.

If you do not agree, do not purchase or use AI Content Manager.

1. About AI Content Manager

AI Content Manager is a self-serve online application that helps users plan, draft, review, create images for and schedule Facebook content using information supplied through their Brand Brain.

The service uses artificial intelligence. Generated posts, images, suggestions and schedules are drafts and may contain errors or require editing. You are responsible for reviewing and approving all material before using or publishing it.

AI Content Manager is a content-support tool. It does not provide legal, financial, medical, accounting or other professional advice.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use the service.

You agree to provide accurate account information and to keep your login details secure. You are responsible for activity performed through your account unless you promptly notify us of unauthorised access.

Accounts and access rights may not be sold, transferred, shared publicly or made available to another person without our written permission.

3. Your Brand Brain and content

You retain ownership of the business information, stories, photographs, brand materials, instructions and other content you submit to AI Content Manager (“Customer Content”).

You give us limited permission to store, process and use Customer Content only as reasonably necessary to operate the service, provide requested features, maintain security, troubleshoot problems and meet legal obligations.

You confirm that:

  • You have the right to submit and use your Customer Content.
  • Your content does not unlawfully infringe another person’s copyright, trademark, privacy, publicity or other rights.
  • You have permission to upload photographs or personal information relating to another person.
  • Information you provide is accurate to the best of your knowledge.
  • You will not use the service to create unlawful, deceptive, abusive, discriminatory or harmful material.

Do not enter sensitive personal information unless it is genuinely required for your content and you are comfortable having it processed by the service.

4. AI-generated content

Artificial intelligence does not guarantee factual accuracy, originality, platform approval or suitability for a particular purpose.

Before publishing, you must review generated content for:

  • Factual accuracy.
  • Correct names, prices, offers and claims.
  • Appropriate tone and context.
  • Intellectual-property concerns.
  • Compliance with advertising, privacy, consumer and platform rules.

You decide whether to edit, approve, publish or discard generated material. You remain responsible for content published through your account.

5. AI Twin and image generation

If you upload an image as an AI Twin or identity reference, you confirm that it depicts you or that you have clear permission from the person depicted to use it for AI image generation.

Generated images are creative outputs and may not perfectly reproduce a person’s appearance, clothing, setting or requested details. You must inspect each image before use.

You must not use AI Content Manager to impersonate another person, mislead people about a person’s identity, or generate unlawful, exploitative or deceptive imagery.

6. Facebook Publisher Companion

The Publisher Companion operates through a Facebook session already signed in within your browser. We do not ask for or store your Facebook password.

You are responsible for:

  • Using the correct Facebook account.
  • Reviewing every post and scheduled time.
  • Complying with Meta’s terms, Community Standards and platform rules.
  • Monitoring your Facebook account for warnings, restrictions or removals.

Facebook and Meta are independent third-party platforms. We cannot guarantee that Facebook will accept, publish, distribute or retain a post. We are not responsible for changes to Facebook, account restrictions, reduced reach, removed content, outages or other platform decisions outside our control.

7. Purchases, access and image credits

Prices and included features are displayed at checkout or within the app. You authorise the applicable payment provider to process the amount shown at purchase.

Access begins after payment and account activation, subject to reasonable processing and technical availability.

Image credits are units that allow eligible image-generation requests. A credit may be deducted when an image-generation request is submitted or completed, as described in the app. Credits have no cash value, cannot be transferred and cannot be redeemed for money.

If credits are deducted but no image is delivered because of a verified system error, we may restore the affected credits or provide another appropriate remedy.

Any refund entitlement is governed by our Refund Policy and applicable law.

8. Acceptable use

You must not:

  • Attempt to access another customer’s account or private information.
  • Circumvent security, credit, payment, usage or access controls.
  • Copy, resell, sublicense or commercially reproduce the app or its underlying systems.
  • Reverse engineer, scrape, probe or interfere with the service.
  • Upload malicious code or use the service to distribute spam.
  • Use the service for unlawful, fraudulent, misleading, defamatory or abusive activity.
  • Violate Meta’s rules or the rights of another person.
  • Use generated content without reviewing it.

We may suspend or terminate access where reasonably necessary to protect customers, the service, third-party platforms or our legal rights.

9. Intellectual property

AI Content Manager, including its software, interface, branding, workflows, prompts, templates and documentation, is owned by or licensed to us and is protected by applicable intellectual-property laws.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable right to use the service for your own business content.

You retain ownership of your Customer Content. To the extent permitted by law and the applicable AI provider’s terms, you may use generated outputs produced for your account.

Because artificial intelligence can produce similar material for different users, we cannot guarantee that any generated output is unique or capable of intellectual-property protection.

10. Availability and changes

We aim to keep the service available and reliable, but uninterrupted access is not guaranteed. Maintenance, security work, internet failures and third-party outages may occasionally affect availability.

We may improve, update, replace or discontinue features. Where a material change significantly affects paid access, we will take reasonable steps to notify affected customers and provide any remedy required by law.

11. Results and earnings

We do not guarantee followers, reach, engagement, leads, customers, revenue, profit or any other business result.

Results depend on factors outside our control, including your Brand Brain, content quality, audience, offer, consistency, decisions, market conditions and third-party platform behaviour.

Please read our Earnings Disclaimer.

12. Third-party services

The app may use or link to third-party services, including hosting, databases, artificial-intelligence providers, payment processors, email providers, Facebook and Meta.

Those services operate under their own terms and privacy policies. We are not responsible for third-party outages, policy changes or decisions, but this does not limit any responsibility we have under applicable law.

13. Suspension and termination

You may stop using the service at any time.

We may suspend or terminate an account if we reasonably believe it is being used unlawfully, fraudulently, abusively, in breach of these Terms, or in a way that threatens the service or another person.

Where appropriate, we will provide notice and a reasonable opportunity to address the issue. Immediate action may be taken where necessary for security, legal compliance or prevention of harm.

Termination does not remove rights or obligations that arose before termination.

14. Consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot legally be excluded, restricted or modified.

15. Disclaimer and limitation of liability

To the maximum extent permitted by law, AI Content Manager is provided on an “as available” basis. We do not guarantee that generated content will be error-free, unique, approved by a third-party platform or suitable for every business.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of reach, loss of data caused by a third-party service, or a decision made by Facebook, Meta or another platform.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

16. Privacy

Our collection, use and handling of personal information are explained in our Privacy Policy.

17. Changes to these Terms

We may update these Terms to reflect changes to the service, law or business operations. The current version will display its last-updated date.

If a change materially affects existing paid access, we will take reasonable steps to notify affected customers.

18. Governing law

These Terms are governed by the laws of Victoria, Australia.

You and we submit to the courts and tribunals with jurisdiction in Victoria, subject to any mandatory rights available under the law that applies to you.
